Living Together

Living together (cohabitation) is becoming increasingly popular. Many of us are cohabiting now or may consider doing so in the future. Becoming aware of some of the misunderstandings about your legal position will better prepare you should the unexpected happen.

Sadly, many relationships breakdown. If this happens you may be homeless, may get nothing if your house is sold or you may find that you do not have legal rights with your children. This can also be the case (regardless of whether a Will has been made) if your partner dies.  Although court proceedings can address some of these situations, the court's powers are limited, often vague and uncertain which result in an unsatisfactory outcome.

How can we help you?
We can draw up one or more of the legal documents listed below, either at the start of your relationship or subsequently, to put into effect what you have agreed.

Parental Responsibility Agreement
- to give you legal rights and responsibilities for your child

Cohabitation Agreement
- to record your intentions in relation to property and other assets to detail what you both intend to happen if the relationship fails. It can address whether the house would be sold, who would care for the children and issues such as maintenance and ownership of household items.

Declaration of Trust
- usually prepared when partners buy a house, it can determine what happens to property if your relationship ends or one of you dies.

Wills
- to avoid the unfairness and uncertainty which often result if one of the partners dies inestate (without a legal Will). Making a Will ensures that your money will go where you want it to rather than to other relatives or to the Government.
