Driving without Due Care

The Offence

If a person drives a mechanically propelled vehicle on a road or other public place without due care and attention or without reasonable consideration for other persons using the road or public place, he is guilty of an offence.

Term Meaning
Public Place Is any place where the public have open access on payment or otherwise.
Mechanically Propelled Vehicle At its most basic level it is a vehicle which can be propelled by mechanical means. It can include both electrically and steam powered vehicles including mini scooters and go peds.

 

Maximum Penalty

  • Fine not exceeding £2,500
  • Licence Endorsed with 3-9 Penalty points
  • Court may disqualify for any period.
