Pre-nuptial agreements

We can advise you on drawing up legal agreements before your marriage or civil partnership to help protect your assets in the event of the relationship dissolving in the future.

In fact, pre-nuptial agreements are not legally binding in the UK in the same way that they are in some other countries. The divorce courts may well choose to ignore a pre-nuptial agreement when dividing matrimonial property, especially if they thought that it was unreasonable to either party.

This doesn’t mean they should be ignored however, as in many cases courts have taken them into account. Certainly, we would advise all couples (especially those where one or more of the partners has significant assets) to consider having one drawn up.
