Debt Recovery

The time comes in any business when people owe you money, and it can be difficult to recover it. Our Spanish Legal Services team can provide you with guidance about how best to proceed to recover money from debtors in Spain. We can also advise you on the best way to enforce your rights.

Our team is also experienced in using European Enforcement Orders where the debt is not contested. We can act on your behalf to certify judgements, settlements or authentic instruments as European Enforcement Orders, in either Spain or the UK.  We can also advise you about obtaining a European Order for Payment.  We can then go on to help you take the right enforcement measures to make sure that your debt gets paid, or is secured.

If you are taking legal proceedings for debt recovery in Spain, there are many things to be considered. Unfortunately, although it might be relatively easy to obtain a favourable judgment against your debtor, the financial situation of the defendant can mean that the judgment is not worth the paper it was written on. It is extremely important to obtain interim reliefs against the assets of the debtor, to guarantee the recovery of the debt once the judgment has been obtained.

We can perform searches and obtain information about the assets of the debtor, whether the debtor is a company or an individual, and provide you with a report about the chances of obtaining a positive outcome to your claim.  Land Registry reports, credit reports or even searches by private detectives, can all help to make sure that everything possible has been done to obtain the payment which is owing to you.

We are qualified to attend in any matter before any Court, Instance and Tribunal in Spain, Ordinary or Constitutional, and to defend your interest at any of those Courts.
