Not all disputes need to go to court in order to resolve the issues involved. In fact, we advocate mediation and negotiation, putting litigation as the last possible course of redress. This is the method advocated by the court and the civil/commercial system. Our procedural knowledge helps us to guide our clients through what is required of them with a creative and tactical approach to the resolution of the disputes. This often takes the form of Alternative Dispute Resolution (ADR) or mediation.

Experience

  • Shareholder or Partnership Disputes: advising clients who trade with others either in partnership or as directors of limited companies. This includes advice to minority shareholders on their rights and remedies, including the possible presentation of unfair prejudice winding up petitions.
  • Restrictive Covenants: advising commercial clients on potential remedies against former directors or employees who appear to be in breach of restrictive covenants contained in their contracts of employment, including the removal of confidential information. Advising individuals and their new employers on whether they are able to resist such a claim.
  • Contractual Disputes: advising clients on how to deal with disputes arising from Commercial contracts including breach of contract claims, whether that be failure to comply with terms of a formal written contract or failure to pay invoices. Claims include seeking a specific amount or seeking an award of damages with the amount to be determined by the court.
  • Debt Recovery: advising clients in the most economical and effective method of pursuing any debt owed or the negotiation with creditors to avoid the court or bankruptcy/insolvency proceedings.
  • Bankruptcy/Insolvency: advising clients about insolvency matters, assisting other lawyers with insolvency implications, and reviewing work carried out on behalf of insolvency practitioners.
