Notification requirements and the police interview

Despite what the name suggests, there isn’t an actual register, and the phrase refers to notification requirements imposed on some offenders convicted of sexual offences.

What are notification requirements?

Notification requirements are an automatic requirement for offenders who receive a conviction or caution for certain sexual offences. The notification requirements are not a punishment for a sexual offence and are not part of the system of penalties.

What will I be asked to do if I have been placed on the register?

The law sets out a number of requirements that you must notify to the police. These are complex and in short are there to ensure the police are informed of your details.

What happens if I do not comply with the order?

If you do not comply with the order you will be committing a criminal offence. The responsibility is upon you to notify the police during the initial notification registration. You must also notify the police within 3 days should the notified details change.

These breaches are treated seriously by the court and are often dealt with in the Crown Court.

I have been asked to attend a police interview for a sexual offence. If I were to accept a caution will I be placed on the sex offenders register?

The acceptance of a caution for certain sexual offences may make you liable to notification requirements. Irrespective of how “trivial” the offence may be, an adult offender who accepts a caution can be liable for registration for a period of 24 months.

If you are 17 or under and accept a caution at the police station you can be liable for registration for a period of 12 months.

Can I avoid being placed on the sex offenders register?

Registration may not be required for certain offences under certain pre-requisites. There is therefore the possibility of refusing a caution and being charged with the offence to avoid automatic registration.
