Background

Dispute Resolution (Personal)

Resolving Personal Disputes

At some point in our lives many of us will end up in a hard-to-resolve dispute with someone – whether it is with an employer, a neighbour, a tenant or someone we are doing business with. Our Dispute Resolution team will help you to resolve that dispute either by negotiation or, if necessary, court action.

The Dispute Resolution Process

The process that you go through to resolve a dispute can be daunting and stressful to navigate. A dispute by its very nature involves conflict. Our team offer a tailored, tactical and personal service using their expertise and knowledge to ensure that your dispute settles with the best outcome for you. The map below illustrates the possible route you might take.

Disclaimer: this graphic has been prepared for general information purposes only. Each claim is different and will have its own path dependent on the particular facts and circumstances of the matter. Specialist legal advice should be taken in relation to your claim.

Fixed Recoverable Costs (FRCs)

Sets the maximum amount of legal costs that a winning party can claim from a losing party in a civil litigation case.

Our FRC flow chart illustrates what happens when a claim is issued at court and what the allocation of a claim means for recovery of legal costs.

Complexity Bands are influencing factors which include value, nature of remedy, complexity of facts/ law/ evidence and number of parties.

For non-money claims or claims involving non-monetary relief, the ‘non-money’ element will be assigned a value to calculate fixed costs.

Note 2: Trial not likely to exceed three days. Oral expert evidence likely to be 2 experts per party. Claim is by 1 claimant vs up to 2 Defendants / 2 Claimants v 1 Defendant.
