Take legal advice when making a Will

How do I reduce family conflict after I die?

A Will is about keeping control and directing where you want your assets to go. It is also about reducing family conflict and emotional upset.

Over the years I have had many a client come in to speak about a relatives Will and looking at how they can claim against the estate.

This is usually due to them being surprised by what is or isn’t in the Will or a concern that a family member has been underhanded. It is normally the time that family conflict which may have been buried, surfaces. The meeting normally starts off with the client saying – “It is the principal of it.”

When we are in a climate of financial difficulty (such as a recession due to a pandemic) litigation claims increase and this is certainly true of claims against an estate.

The legal industry has adapted to this need and many a company offer a no win, no fee service. Simply type into a Google search – ‘inheritance claims no win no fee’ – and you will see what I mean. It is a growing business.

When a family argue, the only true winners are the lawyers. The cost to a family is high not only financially but also emotionally.

It is better to face issues and plan for them and a Will allows you the opportunity to do just that.

When making a Will make sure you are taking advice from a lawyer who understands all of your requirements and concerns. Who can guide you through the process and explain clearly what options are available and the issues that you need to consider.
