Background

Court Proceedings

Legal help when a court proceeding may be required in a family case

Court proceedings may be necessary and we can assist either in issuing an application on your behalf (where you are the “Applicant”) or where your ex-partner or spouse has issued proceedings (where you are then the “Respondent”).

Court proceedings for children matters and matrimonial finances (financial remedy) now have a set timetable that they follow, which is aimed at reducing the amount of time your proceedings take to conclude.

Our lawyers will advise you as to whether your case should proceed to court and undertake the proceedings on your behalf to try and secure the outcome you wish to achieve whilst continuing to advise you throughout. Court proceedings can be stressful and we are also mindful of this and our expert team will do their best to support you through the process. We are also aware that court proceedings can be expensive and therefore we will provide regular updated estimates in respect of your legal costs.

All of our team regularly attend court and therefore are experienced advocates. Our team tries to provide you with continuity of representation but we will advise you if and when we feel it is better for you to have a Barrister represent you and discuss with you who to choose and the cost implications of that choice.
