Individuals and businesses engage the services of professionals for a variety of reasons. However, there are occasions in which the advice given or the services provided are not what was expected or are far from adequate and are considered negligent.

Professional advisors are required to provide ample guidance to their clients, as well as representing their interests. However, in the event that a hired professional provides an inadequate standard of care afforded to a client, they are in breach of their duty of care and should be held accountable. This is known as being professionally negligent.

Often compensation claim cases are subject to time restrictions within which dissatisfied clients can make a claim against their professional advisors. Therefore, it is vital that potential claims are notified and pursued within good time. Most advisors have the benefit of what is known as professional indemnity insurance, so a claimant should be able to recover up to 100% of their losses, as well as the majority of the legal costs they have incurred in pursuing the claim. If no insurance is in place then the claim can be made against the advisor themselves.

How we work

Our specialist team of litigators aim to bring claims to an agreed early settlement with advisors and professional indemnity insurers, to ensure where possible, that a swift and acceptable resolution is achieved. We use our experience, including negotiation and mediation (circumstances permitting) to achieve this.

However, we understand that there are times when a resolution cannot be established early and court proceedings are necessary to recover for a client what they are owed.
